INTRODUCTION
The Force (‘we’, ‘us’, or ‘our’) is a not-for-profit organisation based in County Londonderry, Northern Ireland, operating the website https://theforce.events (the ‘Site’) and providing Drum Major performance displays, tuition services through The Force Academy, and merchandise sales via https://theforce.events/store/ (collectively, the ‘Services’). These Terms and Conditions (‘Terms’) govern your access to and use of the Services, including bookings for performances, tuition, and merchandise purchases. By using the Services, you (‘you’ or ‘Client’) agree to be bound by these Terms. If you do not agree, you must discontinue use of the Services immediately.
DEFINITIONS
The Force: The Force – Display Team of Champion Drum Majors, its members, and representatives.
Client: Any individual, organisation, or entity engaging The Force for performances, tuition, or merchandise purchases.
Services: Professional Drum Major performances at events, tuition through The Force Academy, and merchandise sales via the Site.
Agreement: The contract formeD between The Force and the Client, incorporating these Terms and any specific booking or purchase agreement.
ELIGIBILITY
The Services are intended for users who are at least 18 years old. Persons under 18 may not use or register for the Services without parental or guardian consent. By using the Services, you represent that you have the legal capacity to enter into these Terms.
PERFORMANCE AND TUITION SERVICES :
BOOKING AND CONFIRMATION
- Bookings for performances or tuition must be confirmed in writing and provided by The Force.
- A non-refundable deposit is required to secure a booking. The balance is due as outlined in Section 6.
- The Force will provide a schedule and requirements (e.g., space, equipment, travel or accommodations) upon confirmation. The Client is responsible for meeting these requirements unless otherwise agreed.
CLIENT RESPONSIBILITIES
- The Client must provide a safe and suitable environment for performances or tuition, including adequate space, lighting, and equipment as specified in the booking agreement.
- The Client is responsible for obtaining any necessary permits, licenses, or approvals for the event or tuition session.
- Attendees or participants must adhere to safety guidelines provided by The Force.
- The Client is responsible for the provision of all associated travel, accommodation and food expenses for the event or tuition session.
CANCELLATIONS
- By the Client:
- Cancellations more than 60 days before the event or tuition session forfeit the deposit but incur no further charges.
- Cancellations 30–60 days before incur a 50% cancellation fee of the total agreed amount.
- Cancellations less than 30 days before incur a 100% cancellation fee.
- By The Force:
- The Force may cancel due to unforeseen circumstances (e.g., illness, injury, or force majeure events like natural disasters or government restrictions).
- In such cases, The Force will issue a full refund or offer an alternative date, subject to mutual agreement.
- No refunds are issued for tuition once a session begins, except at The Force’s discretion.
MERCHANDISE PURCHASES
- Merchandise is available for purchase at https://theforce.events/store/, subject to availability. The Force may discontinue items or limit quantities at its discretion.
- Prices are listed in Sterling (GBP) on the Site at the time of purchase, inclusive of applicable taxes unless stated otherwise. Prices are subject to change without notice.
- We accept payments via Visa, Mastercard, American Express, and PayPal. You agree to provide accurate and current payment and shipping information.
- Shipping costs and estimated delivery times are provided at following purchase at checkout. The Force is not responsible for delays caused by third-party shipping providers.
- Returns: Items may be returned within 14 days of receipt if unused and in original condition, with proof of purchase. Contact webadmin@theforce.events to initiate a return. The Client is responsible for return shipping costs unless the item is defective or incorrectly shipped. Refunds are processed within 7 business days of receiving the returned item.
PAYMENT TERMS
- For Performances and Tuition: Payments are due as outlined in the booking agreement, typically with the balance due 14 days prior to the event or session. However, this is at the discretion of The Force. Payments may be made via bank transfer, cheque, or other methods specified in the agreement. Late payments may incur a 5% penalty per week, up to 20%, unless otherwise agreed.
- For Merchandise: Full payment is required at the time of purchase via the Site’s secure payment processors. The Force is not responsible for issues arising from third-party payment processors.
- All fees exclude travel, accommodation, or other expenses unless specified in the booking agreement or at checkout.
INTELLECTUAL PROPERTY
- The Force owns or licenses all intellectual property in the Services, including performance routines, choreography, tuition materials, website content, and merchandise designs (‘Content’), as well as trademarks, service marks, and logos (‘Marks’).
- You are granted a non-exclusive, non-transferable, revocable license to access the Services and download or print Content for personal, non-commercial use only, subject to these Terms.
- No Content or Marks may be copied, reproduced, republished, or exploited for commercial purposes without prior written permission from The Force. Requests should be sent to Info@theforce.events.
- Any breach of these intellectual property rights constitutes a material breach of these Terms, and your right to use the Services will terminate immediately.
USER CONTRIBUTIONS
- The Services may allow you to submit questions, comments, or feedback (‘Submissions’) or post content on blogs, forums, or reviews (‘Contributions’).
- By making Submissions or Contributions, you grant The Force an unrestricted, perpetual, non-exclusive, royalty-free, worldwide license to use, reproduce, distribute, and display such content for any purpose, including commercial use, without compensation.
- You represent that your Submissions and Contributions are original, do not infringe third-party rights, and are not illegal, harmful, or misleading. You are solely responsible for your Submissions and Contributions and will indemnify The Force for any losses arising from breaches of this section.
- The Force may edit, remove, or recategorise Contributions at its discretion without notice.
PROHIBITED ACTIVITIES
You may not:
- Use the Services for any illegal or unauthoriSed purpose.
- Copy, reproduce, or exploit Content or Marks without permission.
- Engage in automated data collection (e.g., bots, scripts) or interfere with the Services’ security features.
- Harass, defraud, or harm The Force or other users.
- Post Contributions that are obscene, defamatory, or violate any law or third-party rights.
- Use the Services for commercial endeavors not approved by The Force.
Violation of these prohibitions may result in termination of your access to the Services and potential legal action.
PRIVACY AND DATA PROTECTION
- The Force collects and processes personal data (e.g., names, contact details, payment information) in accordance with the UK GDPR and our Privacy Policy (available at https://theforce.events/privacy-policy).
- Data is used solely for delivering Services, processing orders, and communicating with Clients. By using the Services, you consent to data processing in the United Kingdom and United States.
- You are responsible for maintaining the accuracy of your data and agree that The Force is not liable for loss or corruption of data you transmit.
LIABILITY AND INSURANCE
- The Force maintains public liability insurance for performances and tuition services. Details are available upon request.
- The Services are provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement. The Force is not liable for errors, interruptions, or third-party content accessed via the Services.
- The Force’s liability for any claim is limited to the amount paid by you for the Services in the six months prior to the claim, or £50, whichever is less, except where prohibited by law.
- The Client will indemnify The Force against claims arising from their use of the Services, breach of these Terms, or failure to provide a safe environment for performances or tuition.
FORCE MAJEURE
The Force is not liable for failure to deliver Services or merchandise due to events beyond its control (e.g., natural disasters, government restrictions, or illness/injury of key personnel). In such cases, The Force will notify the Client and work to reschedule, refund, or arrange alternative delivery as applicable.
GOVERNING LAW AND DISPUTE RESOLUTION
- These Terms are governed by the laws of Northern Ireland, excluding the United Nations Convention on Contracts for the International Sale of Goods.
- Disputes will be resolved through informal negotiation for at least 30 days. If unresolved, disputes will be submitted to binding arbitration under the European Court of Arbitration rules, with one arbitrator, in Belfast, Northern Ireland, conducted in English.
- Exceptions to arbitration include disputes over intellectual property, theft, privacy, or injunctive relief, which will be resolved in the courts of Belfast or, for EU consumers, in their country of residence.
MODIFICATIONS AND TERMINATION
- The Force may modify these Terms at any time, updating the “Last Updated” date. Continued use of the Services constitutes acceptance of revised Terms.
- The Force may terminate or suspend your access to the Services without notice for breach of these Terms or any applicable law. Upon termination, you must cease using the Services.

MISCELLANEOUS
- These Terms, along with any booking agreements or policies on the Site, constitute the entire agreement between you and The Force.
- The Force’s failure to enforce any provision does not waive that provision.
- If any provision is deemed unenforceable, the remaining provisions remain in effect.
- No joint venture, partnership, or agency relationship exists between you and The Force.
